BT/EE successful in appeal of Ofcom’s Annual Licence Fees for spectrum

The UK Court of Appeal has accepted BT/EE’s appeal in relation to Ofcom’s increase in annual licence fees for the 900 MHz and 1800 MHz spectrum bands. As a result of the successful appeal, the UK mobile operators may receive up to £300m in refunds of the fees. CEG’s telecoms team including Paul Reynolds, Professor Maarten Janssen, Dr Barbara Veronese, Jason Ockerby and Alize Perrot supported BT/EE in the Ofcom and appeal processes. As a consequence of the appeal,Ofcom will need to consider the future level of licence fees taking into account relevant duties under the European framework for electronic communications including effects on end-users and investment.
